Abstract

This chapter explores the importance of human rights in underpinning mental health legislation, care and practice. The concepts of capacity and informed consent are discussed in the context of mental health treatment. A case study is used to draw out ethical issues and tensions that exist, particularly around coercive treatment, when delivering mental health care and treatment and trying to protect human rights.
